Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Industrious Technology Services ("we," "us," "our") and your interactions with our AI-powered phone receptionist systems. By placing a call to a business that uses our service, or by receiving a text message you consented to during such a call, you agree to these Terms.
1. Description of service
Industrious Technology Services builds and operates AI-powered phone receptionist systems ("Service") for small hospitality businesses, including but not limited to bed-and-breakfasts, boutique hotels, and charter operators ("Client Businesses"). When you call a Client Business, your call may be answered by our automated receptionist, which is designed to help you with bookings, reservations, general questions, and message-taking.
We provide the technology infrastructure that powers the receptionist. The Client Business sets the policies, pricing, availability, and any commitments specific to their business. We do not control the underlying business decisions of the Client Businesses we serve.
2. SMS communications
Consent. We send a text message only when you verbally authorize it during a phone call with our receptionist. The receptionist will explicitly ask whether you want to receive a text and what number to send it to.
Opt out. Reply STOP to any message from us to be removed from future text communication. Reply HELP for assistance.
Rates. Standard message and data rates from your mobile carrier may apply.
Message types
Messages are transactional and informational only. Examples include:
- Booking links to book a stay at a Client Business
- Restaurant reservation links
- Confirmation of a callback you requested
We do not send marketing or promotional text messages.
Frequency
Message frequency depends on your interactions with Client Businesses, typically one message per phone call.
3. Acceptable use
You agree not to use the Service to:
- Engage in any unlawful activity
- Harass, threaten, or abuse our staff or the Client Business
- Attempt to access systems or data you are not authorized to access
- Interfere with the operation of the Service in any way (including automated calling, denial-of-service attempts, or attempts to manipulate the receptionist for purposes other than a legitimate business inquiry)
- Misrepresent your identity or the purpose of your call in a way that causes harm to the Client Business or other callers
We reserve the right to refuse or terminate service to anyone who violates these Terms.
4. Recording and transcription
Calls handled by our receptionist may be recorded and transcribed for service quality, training, and operational purposes. By continuing the call, you consent to this recording. You may end the call at any time. See our Privacy Policy for how we handle this information.
5. No guarantee of availability
While we strive for high availability, we do not guarantee that the Service will be uninterrupted, error-free, or always available. Phone networks, third-party providers, and other factors outside our control may affect Service availability. Client Businesses retain their own direct phone, email, and web contact methods.
6. Bookings and reservations
When the receptionist sends you a booking or reservation link, the actual booking is made through the Client Business's own booking platform. The terms of the booking, including pricing, cancellation, refunds, and policies, are set by the Client Business and the booking platform, not by us. We are not a party to your booking transaction.
7. Limitation of liability
To the maximum extent permitted by law, Industrious Technology Services and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service shall not exceed one hundred US dollars ($100).
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of the United States Virgin Islands, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be resolved in the courts of the US Virgin Islands.
